Please read these terms carefully before using Fulcrum Digital services.
00 Eligibility
You must be at least 18 years of age to create an account or use Fulcrum Digital services. By signing up, you confirm that you are 18 or older. Fulcrum Digital is not intended for use by minors. If we discover that an account was created by someone under 18, we reserve the right to terminate the account immediately without refund.
01 Services
Fulcrum Digital provides AI-powered digital products and agent-based services. Our offerings include:
- Digital downloads (templates, planners, prompt packs, and other digital files)
- AI document personalization — we use AI to rewrite or customize documents based on your provided information
- AI Agent Sessions — access to autonomous AI agents that perform tasks, research, and operations on your behalf
By purchasing or using any Fulcrum Digital service, you agree to these Terms of Service in full. If you do not agree, please do not use our services.
02 AI Agent Sessions — Uptime & Availability
Important: AI agents are experimental technology. We are committed to transparency about their current limitations and our obligations to you.
- AI agents are experimental technology and may experience interruptions, crashes, or unexpected behavior during operation
- Fulcrum Digital actively monitors all active agent sessions and will restore service as quickly as possible following any interruption
- Session time lost due to agent crashes, platform interruptions, or infrastructure issues will be credited or extended at Fulcrum Digital's discretion
- We do not guarantee uninterrupted or error-free agent access, but we commit to best-effort monitoring, rapid response, and fair remediation
- Agent sessions are provided "as-is" with reasonable care and professional skill; outcomes depend on task complexity and available information
- Fulcrum Digital reserves the right to pause or terminate agent sessions that violate these terms or pose operational risk
We believe in treating customers fairly. If your session is meaningfully disrupted, reach out and we will make it right.
03 Digital Products
- Digital downloads (PDFs, templates, planners, prompt packs, etc.) are non-refundable once delivered, as they are digital goods with instant access
- AI-personalized documents are generated based on information you provide; the quality and accuracy of output depends on the completeness and accuracy of the information you submit
- We do not guarantee that AI-generated content will be suitable for any specific purpose without review and editing by the customer
- It is your responsibility to review all AI-generated output before use in any professional, legal, or financial context
04 Acceptable Use
By using Fulcrum Digital services, you agree not to:
- Use agent sessions or any service for illegal activities, harassment, spam, or fraudulent purposes
- Attempt to circumvent, violate, or exploit the terms of service of any third-party platform through our services
- Attempt to extract, reverse-engineer, replicate, or redistribute the underlying AI systems, models, or operational logic used by Fulcrum Digital
- Use our services to generate content that is defamatory, harmful, obscene, or in violation of any applicable law
- Misrepresent yourself or impersonate others when submitting information for AI personalization
- Share access credentials or session tokens with unauthorized third parties
Violation of acceptable use policies may result in immediate termination of your session or account without refund.
04b Third-Party AI Providers
Fulcrum Digital's agent and AI services are powered by third-party AI providers including Anthropic and OpenAI. By using our services, you acknowledge and agree to the following:
- Your use of Fulcrum Digital services is subject to the applicable usage policies of our underlying AI providers, including Anthropic's Acceptable Use Policy and OpenAI's Usage Policies
- You may not use Fulcrum Digital services in any manner that would violate these third-party provider policies
- Your requests and agent interactions are processed through Anthropic and/or OpenAI APIs. While we do not share your personal information beyond what is necessary to process your requests, the content of your interactions is subject to these providers' data handling practices
- Violations of third-party provider policies may result in immediate suspension of your account and may affect other Fulcrum Digital customers sharing the same infrastructure. Repeated or severe violations will result in permanent termination without refund
- Fulcrum Digital reserves the right to terminate accounts that generate requests violating these provider policies, even if the content does not explicitly violate Fulcrum Digital's own terms
Why this matters: Our services run on shared API infrastructure. A violation that gets our API access suspended affects all customers on the platform. We take this seriously and will act quickly to protect the service for everyone.
05 Limitation of Liability
- Fulcrum Digital's total liability for any claim arising from use of our services is $0.00 (zero dollars). By using our services, you expressly waive any right to damages, compensation, or refunds beyond the protections outlined in our Refund Policy.
- We are not liable for indirect, consequential, incidental, special, or punitive damages of any kind, including but not limited to lost profits, lost data, lost business, reputational harm, or business interruption.
- User Responsibility: You are solely and entirely responsible for all tasks you direct your agent to perform, all content generated through your agent sessions, and any actions taken based on AI-generated output. Fulcrum Digital provides access to AI tools — what you do with those tools is your responsibility.
- We are not liable for decisions made based on AI-generated content. AI output is not professional legal, medical, financial, or business advice. You assume all risk when acting on AI-generated information.
- We are not liable for any third-party claims, fines, penalties, or legal actions arising from your use of our services, including but not limited to copyright claims, defamation claims, or regulatory violations.
- Our services are provided "as-is" and "as-available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
Plain language: You use our AI agent at your own risk. We provide the tools — you own the decisions, the outputs, and the consequences. If something goes wrong with what you choose to do with your agent, that is on you, not us.
06 Privacy & Data
Your privacy is a core commitment, not an afterthought.
Agent Conversations & Session Data:
- Your conversations with your AI agent are private. We do not read, monitor, or analyze the content of your agent sessions except for automated health monitoring (RAM usage, uptime) and when you contact support with a specific issue.
- Conversation history is stored securely and used solely to provide continuity across your sessions. It is not shared with other customers, third parties, or used to train AI models.
- We retain conversation history for up to 90 days after account cancellation, after which it is permanently deleted.
Documents & Submitted Content:
- Documents and content you submit for AI processing are used solely to generate your requested output.
- We do not share submitted content with third parties.
- Submitted content is retained for 30 days for support and quality purposes, then deleted.
Third Parties & Law Enforcement:
- We do not voluntarily share your data with third parties, advertisers, data brokers, or government agencies.
- We will comply with valid legal process (court orders, subpoenas, lawful government requests) when required by law. Where legally permitted, we will notify you before disclosing your data.
- We will push back on overbroad or legally deficient requests.
What We Don't Do:
- We do not sell your data.
- We do not use your conversations or documents to train AI models.
- We do not share your usage data with AI providers (Anthropic, OpenAI) beyond what is required to process your requests.
- We do not monitor conversation content unless investigating a reported violation of these Terms or responding to a valid legal request.
Payment:
- Payment processing is handled by Stripe. Fulcrum Digital does not store your payment card details.
Plan Capabilities:
- Basic ($25/mo): Web search, file creation (Excel, PDF, Word, CSV, SVG), image generation, memory. Does not include code execution, external API calls, or Telegram integration.
- Advanced ($50/mo): Everything in Basic, plus code execution (Python, JavaScript, Node.js) and Telegram integration. Does not include external API calls or custom upgrade requests.
- Premium ($100/mo): Everything in Advanced, plus external API and HTTP calls to third-party services, full tool access, and custom upgrade requests (additional configurations such as channel integrations and workflow automations, fulfilled by Fulcrum Digital on request). Fulcrum Digital reserves the right to decline any custom upgrade request at its sole discretion.
- All plans include a 7-day free trial. No credit card required to start.
AI Credits & Usage-Based Charges:
- Each subscription plan includes a monthly AI credit balance (Basic: $5.00, Advanced: $10.00, Premium: $25.00). Credits reset at the start of each billing period.
- AI usage (conversations, responses, and task execution) deducts from your credit balance based on the computational cost of each interaction.
- Web Search: When your agent performs a live web search, a fee of $0.015 per search is deducted from your credit balance. Web searches are performed when your agent retrieves current information from the internet to answer your query.
- Image Generation: Available on all plans. When your agent generates an image, a fee of $0.15 per image is deducted from your credit balance.
- Credits are consumed as you use the service. You can monitor your remaining credit balance in your agent dashboard at any time.
- When your credit balance reaches $0.00, your agent will be suspended — no AI responses or web searches will be processed until your balance is replenished at the start of your next billing period or through a manual top-up. Your agent configuration and conversation history are preserved.
- Credits have no cash value and are non-transferable. Unused credits roll over as long as your subscription remains active. Credits are non-refundable and are forfeited upon cancellation of your subscription.
You stay in control. Your data is yours.
06b HIPAA & Protected Health Information
Fulcrum Digital is not a HIPAA-covered entity and does not offer a Business Associate Agreement (BAA). Our services are not designed, certified, or intended for use with Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA).
- Do not input patient data. You must not enter, store, or process any PHI through your agent — including patient names, diagnoses, medical record numbers, treatment information, or any other individually identifiable health information.
- Healthcare professionals using Fulcrum Digital agents do so for general administrative, research, writing, and productivity purposes only — not for the storage or processing of patient records or clinical data.
- If you require a HIPAA-compliant AI solution, you must use a service that provides a signed BAA and operates on certified HIPAA-compliant infrastructure. Fulcrum Digital does not currently offer this.
- Fulcrum Digital assumes no liability for any HIPAA violations resulting from a user's decision to input PHI into our services in violation of these terms.
For healthcare professionals: Use your agent for general productivity only. Never enter patient names, records, diagnoses, or any identifying patient information.
07 Changes to These Terms
Fulcrum Digital reserves the right to update these Terms of Service at any time. Material changes will be noted with an updated "Last updated" date below. Continued use of our services after changes constitutes acceptance of the revised terms.
